Former New Jersey JROTC Instructor Avoids Jail After Admitting to Inappropriate Contact With Student
A former Junior Reserve Officers’ Training Corps instructor at a New Jersey high school has been sentenced to probation after admitting he intentionally touched a student without her consent during school hours.
James H. Merritt, 65, of Franklinville, entered a guilty plea during a court appearance in Gloucester County this week in connection with an incident involving an 18-year-old student at Delsea Regional High School. Prosecutors said the incident happened in 2019 while Merritt was working in the school’s Junior ROTC program.
According to court records, Merritt admitted that he intentionally made inappropriate physical contact with the student over her clothing while inside a classroom. The student did not consent to the contact. As part of a negotiated plea agreement, Merritt received probation and will not serve prison time.
The agreement also requires him to surrender his teaching certificate permanently, preventing him from working in public education in the future. He is also prohibited from having any contact with the victim.
Merritt had worked at Delsea Regional High School since 2011 and was previously recognized as the district’s teacher of the year in 2017. However, investigators later accused him of developing what court documents described as an inappropriate relationship with the student both during and after school hours.
Authorities alleged that the conduct included inappropriate sexual behavior and communication outside the classroom, including text messaging after school. Those details were included in investigative documents tied to the case.
The legal case moved through the court system for several years. Prosecutors initially offered a plea agreement in 2019 that reportedly included a five-year prison sentence, but Merritt rejected that deal. In 2021, a grand jury indicted him on charges including second-degree official misconduct and fourth-degree criminal sexual contact. A later indictment filed in 2024 repeated those charges.
Under the final plea agreement reached this year, the official misconduct charge was dismissed. The criminal sexual contact allegation was reduced to a disorderly persons offense of simple assault, to which Merritt pleaded guilty.
Court officials said Merritt declined to speak before sentencing when given the opportunity by the judge. According to court paperwork, his probation sentence will remain in effect until all fines and court-related financial obligations are paid.
The case has drawn attention in Gloucester County because of Merritt’s former role in the school district and his involvement with students through the Junior ROTC program. The outcome also highlights how plea agreements can significantly change the penalties tied to criminal charges before sentencing is finalized.
